1. subject of the conditions of participation and organizer

[1] These conditions of participation regulate the conditions for participation in the sweepstakes. The description and the course of the respective game shall take place within the framework of the respective sweepstakes promotion on the Facebook page and Instagram page of bittl Schuhe + Sport GmbH.

[2] The organizer of the contest is bittl Schuhe + Sport GmbH (hereinafter the "Organizer", or "we") - Georg-Reismüller-Str. 5, 80999 Munich, Germany, phone: +49 89 89219-180, fax: +49 89 89219-181, email: contest(at)bittl.de. Facebook/ Instagram is not the organizer of the contest and therefore in no way responsible for its content. Facebook/ Instagram does not support, sponsor or organize the contest.

[3] These terms and conditions shall be deemed to have been accepted upon participation in the competition.

2nd Participation

[1] All persons who are resident within the EU and have reached the age of 18 are eligible to participate in the competition. Excluded are employees of the organizer, their relatives (spouses, children, parents and siblings), sweepstake clubs and "robots", i.e. automated services. Participation with fake identities or with identities of third parties is not allowed.

[2] Each person may only participate once in the sweepstakes.

[3] Participation is free of charge and independent of the purchase of goods or services.

[4] The condition of participation is the registration for the competition and the transmission of correct data on the part of the participant as well as his declaration of consent to the use of his data for the purpose of carrying out the competition. The registration can be made via the Facebook page/ Instagram page of bittl Schuhe + Sport GmbH.

[5] Participation is possible from 07.11.22 - 27.11.22.

[6] Within the scope of the competition, there is the possibility to register for the newsletter of the organizer, without the registration being a prerequisite for participation. It is possible to unsubscribe from the newsletter at any time with effect for the future.

3. prizes and notification of prizes

[1] Among all eligible participants we will raffle 1 stay for 2 persons for 3 nights incl. half board at Hotel Alpina in Obertauern.

[2] The winner will be determined by drawing lots. The winner will be informed of his prize within 1 week after the end of the competition by email to the email address he has provided or via Facebook/Instagram messenger. The organizer is not obliged to determine correct contact details (for example, if incorrect data is entered), the participant is responsible for the correctness of the address provided.

[3] The winner must confirm receipt of the prize notification and acceptance of the prize within two weeks to the email address contest(at)bittl.de or to the Facebook/Instagram Messenger. If we do not receive a corresponding e-mail from the winner within the specified period or if the winner cannot be contacted at the specified e-mail address/account, the claim to the prize will expire. In this case, we are entitled to conduct a substitute draw. The winner will again be expressly informed of the confirmation requirement in the prize notification.

[4] Payment in cash, in exchange for a voucher, exchange for other products or transfer to other persons is not possible.

[5] The prize will be sent to the winner free of charge within the EU. The service provider for the shipment will be determined by bittl Schuhe + Sport GmbH. No influence can be exerted on the type and duration of delivery.

[6] If circumstances occur for which we are not responsible, the respective winner will accept an appropriate replacement prize. Such circumstances for which we are not responsible are in particular those which lie with the sponsors of the prizes.

4 Exclusion of participation

[1] A violation of these conditions of participation entitles us to exclude the respective participant from participation. This applies in particular if the participant makes false statements or is not eligible to participate as defined in. Clause 2.

[2] If the excluded participant is a winner drawn by lot, the prize can be subsequently revoked.

5 Early termination and changes

We reserve the right to prematurely terminate the competition in whole or in part at any time for good cause, even without observing deadlines, or to change its course, in particular if it is not possible for technical or legal reasons to guarantee proper implementation of the competition.

6. data protection

[1] The organizer is the responsible party for all personal data of participants collected, processed and used within the scope of the sweepstakes. All personal data will be treated confidentially and used only in accordance with the legal provisions of data protection. We will only collect, store, process and use the information insofar as this is necessary for the implementation of the competition or insofar as the participant has consented to the sending of the newsletter. The data will not be passed on to third parties unless you give your separate consent for this. The legal basis for the data collection and use is Art. 6 para. 1 b EU-DSGVO. If you have also given your consent to the use of data, the legal basis is Art. 6 para. 1 a EU-DSGVO.

[2] The participant may at any time request information about the data stored about him and its deletion or correction or restriction of processing. [4] The data will only be used to carry out the competition and will be deleted after the end of the competition. The data of participants who have registered for the newsletter will be included in the newsletter distribution list of bittl Schuhe + Sport GmbH and used and processed there.

7 Liability

[1] A liability of sport bittl Schuh und Sport GmbH - no matter on which legal ground - exists only if a damage was caused by culpable violation of an essential contractual obligation (cardinal obligation), which makes a proper fulfillment of the contract possible in the first place and on which the participant trusted and could trust, in a way endangering the achievement of the purpose of the contract or if it is due to intent or gross negligence.

[2] The above exclusion of liability shall not apply to claims for damages arising from injury to life, body or health, if sport bittl Schuh und Sport GmbH is responsible for the breach of duty, and to compensation for other damages based on a wilful or grossly negligent breach of duty by the seller. A breach of duty by sport bittl Schuh und Sport GmbH is equal to a breach of duty by a legal representative or vicarious agent.

[3] As far as the liability of sport bittl Schuh und Sport GmbH is excluded or limited according to the regulations of this disclaimer, this also applies to the personal liability of organs, employees, representatives and vicarious agents.

8. final provisions

[1] Should the conditions of participation contain invalid provisions, the validity of the remaining conditions shall remain unaffected.

[2] German law shall apply, place of jurisdiction shall be Munich. Legal recourse to review the draw is excluded.

[3] In accordance with Directive 2013/11/EU, the EU Commission is setting up an Internet platform for the online settlement of disputes ("ODR platform") between entrepreneurs and consumers.
